ARTICLE 160: OTHER REQUIREMENTS TO BE MET BY THE LEGAL REPRESENTATIVE

     

    In addition to what is stated in the previous article, the legal representative must comply with the following requirements, which without may not be authorized to review the confidential information:

  • Not have been convicted of a sentence executed for a criminal offense;
  •  

  • Enjoy a good personal and professional reputation;
  •  

  • Not having been a partner, having held a management position or having served as a salaried attorney or mandatary of the company that it intends to represent, nor of any of the interested parties or co-adjuvants in the proceedings under way, in the last year, and
  •  

  • Display any form of guarantee for the amount set by the Ministry (RLCE: Art. 1) in accordance with the Federal Fiscal Code (Código Fiscal de la Federación), in the event that any of the illicit described in section VI of article 93 of the Law (LCE: Art. 93). The guarantees may be canceled after the publication of the resolution in question, provided that the obligation referred to in section IX of article 159 of these Regulations has been fulfilled.     Once the requirements have been met, the Ministry will have the legal representative accredited and will issue the corresponding certificate within a period of ten days from the submission of the request; This period will not apply to the certificates or authorizations that are issued in connection with the dispute resolution mechanisms provided for in the international trade agreements or treaties to which Mexico is a part of, or in the rules of procedure or provisions that emanate from them.
