ARTICLE 124: DATA THAT MUST CONTAIN THE RESOLUTIONS OF THE SE (SECRETARY OF ECONOMIA)

     

    The resolutions declaring the acceptance of the request and the initiation of the administrative investigation or imposing provisional or definitive safeguard measures must be well founded and motivated. Consequently they must contain the following data (RLCE: Art. 126):

  • The competent authority issuing the act;
  •  

  • The name or business name and address of the applicant or the applicants for the investigation;
  •  

  • The name or business name and address of the importer (s) and exporters known;
  •  

  • The country or countries of origin or provenance of the identical, similar or directly competitive merchandise;
  •  

  • The description of the procedure in question;
  •  

  • The description of the merchandise under investigation, indicating, among other data, the corresponding tariff fraction of the Tariff of the Law on General Import and Export Taxes (Tarifa de la Ley de los Impuestos Generales de Importación y de Exportación);
  •  

  • The description of the identical, similar or directly competitive national merchandise to the merchandise under investigation;
  •  

  • The period under investigation;
  •  

  • The reasoning and circumstances considered by the authority to issue the resolution, and
  •  

  • The other data agreed in international treaties or conventions to which Mexico is a part of, and those considered by the Ministry. (RLCE: Art. 1)
