    • ARTICLE 99: REASON FOR REVIEWING THE DEFINITIVE COMPENSATORY FEES

     

    In the terms of article 68 of the Law (LCE: Art. 68), the Ministry (RLCE: Art. 1) will carry out a review on the occasion of a change in the circumstances for which it was determined:

  • The definitive compensatory fee; or

    •  

  • The existence of price discrimination, or, where appropriate, of the subsidy, and / or

    •  

  • Damage to the national production.

    • In the procedure for reviewing definitive compensatory fees, the procedural provisions set forth in the Law and in these Regulations shall be observed, relating to the beginning of the proceedings, preliminary resolution, final resolution, conciliatory hearing, compensatory fees, exporter and government commitments, evidence, allegations, public hearings, technical information meetings, notifications, verifications and other provisions common to the procedures.
