ARTICLE 59: ELEMENTS THAT DETERMINE THE EXISTENCE OF DAMAGE
The Ministry (RLCE: Art. 1) must verify, through the corresponding investigation procedure, that the damage referred to in article 39 of the Law (LCE: Art. 39) derives from the minimum analysis of all the elements referred to in articles 41 and 42 (LCE: Art. 41) (LCE: Art. 42) of the same order, as appropriate. In no case, the investigating authority will determine the existence of damage according to what is established by the civil legislation.
