ARTICLE 9: ISSUS ON WHICH THE COCEX (FOREIGN TRADE COMMITTEE) EMITS AN OPINION
For the purposes of article 6 of the Law (LCE: Art. 6), the Commission (RLCE: Art. 1) will be in charge of issuing an opinion on the convenience of adopting the following measurements, prior to its issuance and during its validity:
The establishment, increase, decrease or elimination of tariffs or tariff preferences for the export or import of merchandise;
The establishment, modification or elimination of prohibitions on the export or import of merchandise;
The establishment, modification or elimination of non-tariff regulation and restriction measures for the export or import of merchandise, as well as the procedures for their issue;
The establishment, modification or elimination of measures to regulate or restrict the circulation or transit of foreign merchandise coming from and destined abroad;
The procedures for assigning export or import quotas;
The establishment, modification or elimination of rules of origin;
The requirement of compliance with official Mexican standards by the customs authorities at the point of entry of merchandise into the country;
The establishment of emergency non-tariff regulation and restriction measures, established in accordance with article 19 of the Law (LCE: Art. 19); The establishment of safeguard measures; The establishment of customs measures that affect foreign trade; The establishment of simplification and administrative efficiency measures in foreign trade matters; The establishment of other administrative measurements of the dependencies and entities of the Federal Public Administration (Administración Pública Federal) whose purpose is to regulate or restrict the country's foreign trade and the circulation or transit of foreign merchandise; The final draft resolution in investigations regarding unfair international trade practices and the determination of compensatory fees; The draft resolutions in which the Ministry (RLCE: Art. 1), accepting the commitment of foreign exporters or governments, suspend or terminate an investigation on unfair international trade practices, and
The criteria for tariff classification proposed by the Secretary of Finance and Public Credit (Secretaría de Hacienda y Crédito Público) in accordance with the Law on General Import and Export Taxes (Ley de los Impuestos Generales de Importación y de Exportación).The Commission will periodically review the regulatory and restriction measures to foreign trade that are in force, such as prior permits, maximum quotas, country of origin labeling, certificates of origin and compensatory fees, in order to recommend the modifications that may take place. Likewise, it will be responsible for exercising the other functions conferred by the Law, these Regulations and other applicable legal and regulatory provisions.
The measures referred to in the first paragraph of this article must be published in the Official Journal of the Federation (Diario Oficial de la Federación).
