ARTICLE 80: INFORMATION AVAILABLE TO INTERESTED PARTIES
The Ministry (LCE: Art. 3) (RLCE: Art. 1) will grant interested parties? an appropriate access (RLCE: Art. 147) to examine all the information contained in the administrative file (RLCE: Art. 138) for the presentation of their arguments. Confidential information (RLCE: Art. 149) (RLCE: Art. 158) will only be available to the accredited legal representatives of the interested parties, and to the individuals or legal entities that under the international treaties or conventions to which Mexico is a part of may have access to it. In any case, authorization from the Ministry must be obtained. The commercial information reserved (RLCE: Art. 150) (RLCE: Art. 158) and confidential government information (RLCE: Art. 154) will not be available to any of the interested parties.
People authorized to access confidential information (RLCE: Art. 159) (RLCE: Art. 160) (RLCE: Art. 161) will not be able to use it for personal gain and will have the obligation to take all the necessary measures to avoid any form of disclosure of it. The contravention to this precept will be sanctioned by the dispositions of this Law (LCE: Art. 93), regardless of the penal and civil penalties that may apply.
During the investigation procedures referred to in this title, at the request of the interested parties or their representatives, the Ministry will give appropriate access to all non-confidential information (RLCE: Art. 148) contained in the administrative file of any other investigation, after 60 days of the publication of the corresponding final resolution.
