ARTICLE 69: REVIEW OF DEFINITIVE COMPENSATORY FEES TO COUNTERACT THREATS OF DAMAGE
When the definitive compensatory fees have been imposed to counteract threat of damage caused by imports under conditions of price discrimination (RLCE: Art. 38) or subsidy (RLCE: Art. 38A), the review should include, where appropriate, an evaluation of the investment that without the compensatory fee would not have been feasibly carried out. The compensatory fee may be revoked by the Ministry (LCE: Art. 3) (RLCE: Art. 1) in case the projected investment has not been made.
