ARTICLE 19: ESTABLISHMENT OF MEASURES WITHOUT THE OPINION OF THE FOREIGN TRADE COMMISSION

     

    Notwithstanding the provisions of article 17 (LCE: Art. 17), the dependencies of the competent Federal Executive may establish regulation or non-tariff restriction measures for the export, import, circulation or transit of merchandise in the cases provided for in sections III to VI of article 15 and VI of article 16 (LCE: Art. 15) (LCE: Art. 16) without submitting them to the opinion of the Commission (LCE: Art. 3) (RLCE: Art. 1), provided that:

  • It is an emergency situation that liable to cause damage that is difficult to repair if the procedure indicated in Article 17 is followed; (LCE: Art. 17) (RLCE: Art. 9)
  •  

  • The Commission is notified;
  •  

  • It is published in the Official Journal of the Federation (Diario Oficial de la Federación), where appropriate, by agreement of the head of the respective agency, and
  •  

  • The validity of the measure is limited to a maximum period of 20 days from the first act of applying the measure, within which said measure and, where appropriate, the issuance of the official Mexican standard of emergency, in the terms of the legislation in the matter, must undergo the procedure established in article 17.
