ARTICLE 157: ASSETS EXCEPTED FROM GARNISHMENT

     

    They are exempted from embargo:

  • The daily bed and the clothes of the debtor and their relatives.
  •  

  • The furniture of indispensable use of the debtor and their relatives, not being luxurious in the judgment of the executor. In no case shall the goods referred to in the other sections of this article be considered as luxury, when used by the people that, where appropriate, the sections establish themselves.
  •  

  • The books, instruments, supplies, and furniture essential for the exercise of the profession, art, and trade to which the debtor is dedicated.
  •  

  • The machinery, equipment, and livestock of the negotiations, as soon as they are necessary for their ordinary activity in the judgment of the executor but may be subject to embargo with the negotiation in their entirety if they are intended for it.
  •  

  • The weapons, vehicles, and horses that the military on duty must use according to the laws.
  •  

  • Grains, as long as they have not been harvested, but not the right to plant.
  •  

  • The right of usufruct, but not the fruits therefrom.
  •  

  • The rights of use or habitation.
  •  

  • Family estates under the terms established by law, since their registration in the Public Registry of Property.
  •  

  • Salaries and wages.
  •  

  • Pensions of any kind.
  •  

  • The ejidos.
  •  

  • Deposits that a person has in their individual retirement savings account, including voluntary and complementary contributions up to an amount of 20 minimum salaries per year, in accordance with the provisions of the Law on Retirement Savings Systems (Ley de los Sistemas de Ahorro para el Retiro).
